Platform Limitations
Unsupported Platforms
NOLA Media & Design does not provide design, development, or technical support for third-party platforms including Squarespace, Wix, Shopify, or Google Workspace (Gmail).
Maintenance & Security Responsibility
Websites not enrolled in an active Maintenance Plan are not monitored for updates, security, performance, or uptime.
NOLA Media & Design assumes no responsibility for vulnerabilities, malware, downtime, data loss, or functionality issues resulting from outdated software, compromised credentials, third-party tools, hosting environments, or lack of maintenance.
Clients who opt out of a Maintenance Plan accept full responsibility for the ongoing security and upkeep of their website.
Emergency Security Remediation
If a website is identified as compromised, infected, or posing a risk to users, search engines, or hosting infrastructure, prompt action is required.
For clients enrolled in an active Maintenance Plan, NOLA Media & Design reserves the right to take immediate corrective action without prior approval to contain threats and prevent escalation.
For clients not enrolled in a Maintenance Plan, all remediation work requires written approval prior to initiation.
Delays in response may result in:
- Hosting suspension or account restrictions
- Search engine deindexing or domain reputation damage
- Continued malware distribution or unauthorized access
Emergency remediation may include:
- Malware removal and file cleanup
- Removal of spam content, backlinks, and injected code
- Core, plugin, and theme updates
- Isolation or suspension of vulnerable components
- Initial security hardening
All time incurred is billable at the standard hourly rate unless covered under an active maintenance or prepaid support plan.
Clients will be notified as soon as reasonably possible following any approved or necessary intervention, along with a summary of work performed and associated costs.
Ongoing Risk & Client Responsibility
Websites without an active Maintenance Plan remain significantly more vulnerable to security breaches, performance issues, and compatibility failures.
Security monitoring, updates, and protection are not included outside of these plans.
Failure to maintain updated software and basic security practices increases the likelihood of:
- Malware infections
- Spam content and malicious backlinks
- Data breaches
- Hosting suspension or domain blacklisting
NOLA Media & Design is not liable for recurring issues, damages, or losses resulting from lack of maintenance or delayed response to security incidents.

Results Disclaimer
While we implement proven strategies to improve performance and visibility, specific results cannot be guaranteed.
Copyright + Intellectual Property
We do not grant or authorize access to any website we have designed to another designer for the purpose of duplication, reuse, or repurposing of the design or structure. Copying or reusing any portion of a website design created by NOLA Media & Design is prohibited.
A “Website Designed by NOLA Media & Design” credit is placed in the footer of websites we design. This credit may be removed at the client’s request; however, another designer or agency may not replace our business name with their own.
All website designs, layouts, and visual structures created by NOLA Media & Design remain our intellectual property unless otherwise agreed to in writing. Clients retain full ownership of the text, images, and other content they provide.
We have no interest in “owning” a client’s website or restricting its use. This section exists solely to protect our work from unauthorized copying, duplication, or misrepresentation by third parties.
DESIGN PHASE
These terms are in place to help ensure your project is completed efficiently, securely, and to your satisfaction.
Once a design sample is approved, clients have 30 days to provide all remaining content and revision requests so the website can be completed and migrated from our staging server to the designated server.
Requests made outside the approved project scope or beyond the design phase timeframe are billable at our standard hourly rate or via a Prepaid Reduced-Rate Plan. Included content changes during the design phase vary by project—please refer to your approved proposal for specifics.
Pending or inactive website projects will be removed from our hosting servers after 12 months of inactivity. Clients may request continued staging/hosting for inactive projects at a rate of $99/year.
Websites remaining on our servers beyond the designated design phase require ongoing system maintenance to remain secure and up to date. Any time required for this maintenance is billable.
3RD PARTY PRODUCTS
Third-Party Products
There is no long-term contract for our design or marketing services. However, websites rely on third-party products that carry their own terms, fees, and renewal requirements.
These may include, but are not limited to:
- Web hosting
- Email hosting
- Domain names
- SSL certificates (HTTPS)
- Premium (“pro”) themes, plugins, or software
Most third-party products require annual renewal and are billed separately from our services.
NOLA Media & Design does not control third-party pricing, policies, or changes.
Management & Support
If we purchase, configure, or manage third-party products on your behalf, support time applies to tasks including:
- Product purchasing and renewals
- Vendor communication
- Setup, configuration, and optimization
- Troubleshooting coordination
We do not provide direct technical support for third-party vendors or their platforms.
Website & Email Hosting
Hosting is a required third-party service that stores your website files and email data.
- Hosting is rented, not owned, and must be actively maintained
- Failure to renew may result in suspension or permanent data loss
- Hosting providers control all data retention and deletion policies
We do not maintain off-server backups unless a backup service is purchased.
Optional Backup Service
Annual Backup Service: $69/year (must be added prior to hosting expiration)
- Backups are provided to the client upon request
- Copies are retained by us for up to 30 days only
- Once hosting is terminated and data is deleted by the provider, recovery is not possible
Domain Names
Domains are required for your website, email, and online services.
- Domains must be renewed annually
- Expired domains may enter a redemption period with additional fees
- If not renewed, domains may be released for public purchase (typically within 60–80 days, occasionally up to 120 days)
SSL Certificates (HTTPS)
SSL certificates secure data between your website and its users and are required for:
- Contact forms
- Login areas
- Payment processing
- Any data collection
SSL certificates are third-party products and must be kept active and renewed.
Renewals, Expiration & Liability
- Expired products may incur vendor late or restoration fees
- Not all expired services can be recovered
- Assistance with reinstatement is billable at standard hourly rates
- We are not responsible for service interruption, data loss, or domain loss due to non-renewal
NOLA Media & Design is not obligated to send repeated renewal reminders once an initial notice or invoice has been issued.
